The European Ombudsman wrote to the President of the European Commission, Ursula von der Leyen, following a complaint filed for failure by the European Commission to communicate text messages exchanged by the President with the CEO of Pfizer last spring . We give below a translation of the letter sent by Mrs O'Reilly, Ombudsperson of the European Union, to Ursula von der Leyen, following a complaint lodged to obtain communication of the messages exchanged between the President of the European Commission and the CEO of Pfizer.
In April 2021, The New York Times reported that the President of the Commission had texted and called with Pfizer CEO Albert Bourla for a month in negotiations to buy vaccines for the bloc.
Emily O’Reilly asked the Commission to hand over the text messages to her, but the Commission claimed that "no records have been kept of such messages", according to the Ombudsman’s office. Yet "the EU administration is bound by the EU's right to establish and keep documents relating to its activities, to the extent possible and in a non-arbitrary and predictable manner."
We thus lift the veil on the enormous gap that exists between the proclamations by the European institutions of their respect for the rule of law and reality. Not only are simple administrative procedures not followed, but we realize that the President of the Commission is in dialogue directly with the CEO of a potential supplier, in disregard of respect for tendering procedures and ethics. We do not even talk about the question of democratic control of decisions taken by the European Commission.
Before having other elements, it will be noted that Mrs von der Leyen practices, without a shadow of a doubt or prudence, the connivance of the leading globalist circles among themselves.

Madame President,
I received a complaint from X against the European Commission. It concerns public access to "text" messages relating to the conclusion of a purchase agreement for a COVID-19 vaccine earlier this year, as the New York Times reported
In the event that public access to documents is refused under Regulation 1049/2001,
applicants can turn to the Mediator. In this context, I am opening an investigation into this complaint.
The Commission partially disclosed three documents to the complainant, but said it did not have any documents relating to any “text” messages relevant to the request. The Commission also stated
that it does not have to "preserve every document" and that "text messages" are generally "ephemeral" in nature and therefore, in principle, excluded from its archiving policy.
Given the alleged purpose of the texts, the complainant considers that these messages
come under the concept of “document” within the meaning of Regulation 1049/2001.
I decided that it was necessary for my investigation team to meet with representatives of the Commission in order to obtain further information. More specifically, I would like
that the Commission can, during this meeting, explain
- its policy on recording text messages and how this policy is implemented in practice
- whether, and if so, how and where, it searched for possible text messages falling within the scope of the Data Protection Directive.

I would be grateful if the representatives of the Commission concerned could contact Ms. Michaela Gehring, who is the investigator in charge of this investigation, in order to agree on the modalities of the meeting to take place before 8 October 2021, if possible.
Information or documents which the Commission considers confidential will not be disclosed to the complainant or to any other person without prior agreement.
